Terms of Service

Version 2026-10-01In effect for new accounts from 4 October 2026, and for existing accounts from 3 November 2026.

1. Who we are

Wine Brats — the Wine Brats iOS app and the website winebrats.ai, together "the Service" — is provided by myrandomcompany Incorporated, a Delaware corporation, 1007 N Orange St, Fl 4, Wilmington Delaware 19801-1242, United States ("we", "us"). You can reach us at legal@winebrats.ai.

These Terms are a contract between you and us. Our Privacy Policy explains how we handle personal data; it is not part of this contract.

2. Who can use Wine Brats

You must be at least 21 years old, wherever you live, and of legal drinking age where you are if that is higher. You must be able to enter into a binding contract and not be barred by law from using the Service.

If you use Wine Brats for a restaurant or another business, you confirm that you may act for it, and these Terms also bind that business. We may close an account that we reasonably believe belongs to someone under 21.

3. Your account

You create an account in the iOS app with an email address and password, Sign in with Apple, or Google sign-in. The website does not offer sign-in. You accept these Terms when you create an account or, if you already have one, as described in section 17.

Give accurate information, keep one account per person, keep your password safe, and tell us at legal@winebrats.ai if you think someone else is using your account. Apple's and Google's own terms apply to their sign-in services.

You can delete your account at any time in the app (Account → Settings → Delete My Account) or by emailing legal@winebrats.ai. Section 6 explains what happens to your uploads when you do.

4. What Wine Brats does

Wine Brats turns a photo, PDF or link of a restaurant's wine list into a list you can search and filter. AI services read the list for us. You can check the result before it is saved; it is then added to that restaurant's list in Wine Brats for all users.

We show list prices as printed, and may convert them into another currency using reference exchange rates. Next to wines we show ratings and average retail prices from third-party sources, mainly Wine-Searcher, with a link to wine-searcher.com. Wine-Searcher's information belongs to Wine-Searcher or its licensors and is shown with its permission. We never credit Wine-Searcher for a figure that did not come from it. Restaurant names, addresses and locations may come from Google Maps (see section 12).

Wine Brats is free. We don't sell or deliver alcohol, take orders, bookings or payments, or act for any restaurant or shop. Anything you buy through a link is between you and the seller, under the seller's terms. Please drink responsibly.

We may add, change, pause or remove features. Section 17 explains how we tell you about significant changes.

5. Accuracy

AI can misread wine names, vintages, sizes and prices, and may suggest details that weren't printed, such as a grape or a region; these can be wrong. List prices are what the restaurant printed when the list was added. Restaurants change prices and run out of wines, and you pay what the restaurant charges.

Ratings and retail prices from third parties may be inaccurate or out of date. An average retail price is the average shop price in the restaurant's country, excluding tax, for a 750 ml bottle, on the date shown next to it. Restaurant prices usually include tax and service. A markup we calculate between a list price and a retail price is an estimate for information only. We show it only when both currencies are known, the bottle is 750 ml, the vintages are known and match, the retail figure is an average rather than a starting price, and it is less than 90 days old. It is not a statement that any price is fair or unfair.

Nothing in Wine Brats is professional advice. Please check with the restaurant, and tell us about mistakes (section 9).

6. Content you add

"Your content" means photos, PDF files, links, corrections, ratings, suggestions, reports and anything else you add. You keep any rights you have in it.

You give us a worldwide, non-exclusive, royalty-free licence to host, store, copy, process, adapt (for example crop, rotate, compress, convert and add highlights), display and make your content available to other Wine Brats users, so that we can run, secure and improve the Service. Service providers may do this for us, including the AI services that read your uploads; our Privacy Policy lists them.

Menu photos you upload can be shown to other signed-in users next to the wines read from them. Your name and email address are not shown to other users.

Wine details read from a list — names, producers, vintages, sizes, prices and similar — describe what the restaurant offers. Once saved, they become part of that restaurant's list in Wine Brats and stay there after you delete your account, with no link to you. To the extent you have rights in those details, this licence for them is perpetual and irrevocable. For photos and files, the licence ends when we delete them, for example when you delete your account. Copies can remain in backups until our backup schedule deletes them (see our Privacy Policy), or longer where the law requires us to keep them.

You may correct the vintage of a wine read from a list you uploaded; other details, ratings and prices can't be changed by uploaders. Restaurant partners can also correct their own restaurant's wine details and list prices. We keep a record of every change.

You confirm that you have the right to share your content, that you captured it lawfully, and that it follows section 7. If you send us suggestions, we may use them without any obligation to you.

7. Rules for using Wine Brats

There is no tolerance for objectionable content or abusive users on Wine Brats. Upload only wine lists, drinks menus and similar lists from restaurants, bars and shops.

Don't upload, link to or share:

  • anything illegal, or anything that promotes illegal activity;
  • child sexual abuse material, or any sexualised content involving minors;
  • terrorist content, intimate images shared without consent, hate speech, threats or harassment;
  • other people's personal information, such as identifiable faces (crop to the list where you can), names, phone numbers, receipts or bills, payment card details or private documents;
  • content that infringes copyright, trade marks or other rights, including lists copied from other wine-list apps or websites that collect lists (a link to a restaurant's own wine list is fine);
  • false or misleading information, such as invented wines or prices, or changes meant to mislead people about a restaurant or a wine.

Don't:

  • scrape, crawl, harvest or bulk-download content or data from Wine Brats, or access it with bots or other automated means, unless we agree in writing;
  • use Wine Brats or its data to build another database or service, or to train AI models;
  • copy, decompile or reverse-engineer the app, except where the law allows it;
  • interfere with security, get around rate limits or access controls, or access another person's account;
  • impersonate anyone, or claim to represent a business you don't represent;
  • use Wine Brats if you are under 21, or to encourage irresponsible or underage drinking.

8. How we moderate content

People at Wine Brats review reports and decide what to do. AI reads uploads only to pull out wine information, and automated checks decide whether to draw a highlight on a photo. These tools don't decide whether content is allowed, and we don't currently use automated tools to detect illegal content. If that changes, we will update this section.

If content or conduct breaks the law or these Terms, we may: hide or remove a photo or file (one page, or every page of the same upload); remove or correct a wine entry or a restaurant's details; hide a restaurant or a calculated figure; limit your ability to upload or edit; or suspend or close your account.

We act carefully, objectively and in proportion. We take into account how serious the problem is, whether it has happened before, and the rights and interests of everyone involved, including freedom of expression and information. After a warning, we may suspend for a reasonable period accounts that often share clearly illegal content, and stop handling reports from people who often send clearly unfounded ones.

If we learn of something that suggests a criminal offence threatening someone's life or safety, we tell the police or other relevant authorities. We report child sexual abuse material to the authorities, such as the National Center for Missing & Exploited Children in the United States. We comply with valid orders from courts and authorities.

9. Reporting content

Anyone can report content, with or without an account. Use the form at winebrats.ai/report, the Report option in the app where your version offers it, or email legal@winebrats.ai. Please include:

  • where the content is (the restaurant and wine, or a winebrats.ai link);
  • why you think it is illegal or breaks these Terms;
  • your name and email address; and
  • a statement that you believe in good faith that your report is accurate and complete.

For copyright, also identify the work and your right in it. You can report illegal content, including child sexual abuse material, without giving your name or email address. Reports of child sexual abuse material are never linked to your account, and we treat them as urgent.

We confirm that we received your report, review it promptly and fairly, and tell you what we decided, whether we used automated tools, and how to challenge the decision. Restaurants can use the same routes to correct their details or object to a listing, and anyone can report wrong prices, ratings or other errors this way.

10. If we act on your content or account

If we hide or remove a photo or file you uploaded, or suspend or close your account, we email the address on your account by the time the decision takes effect. The only exceptions are when the law or an order from a court or authority stops us, or when we have no way to contact you. We tell you what we did and for how long, the facts behind it (including whether it followed a report), whether automated tools were used, the law or the part of these Terms we relied on and why, and how you can challenge the decision.

Wine entries and restaurant details belong to the restaurant's shared list, not to the person who added them (section 6). When we correct or remove one, we are correcting the list, so we don't email the person who added it. If a correction affects you, you can still ask us about it at legal@winebrats.ai.

11. Complaints and appeals

Within 6 months of a decision, you can ask us to look at it again: reply to our email, use the form at winebrats.ai/report, or write to legal@winebrats.ai with "Appeal" in the subject. This covers decisions about your content or account and decisions on a report you made. You can also complain about how we handle reports or about how we meet our legal duties.

A person, not an automated system alone, reviews your complaint and looks at the facts again. We aim to reply within 14 days. If we got it wrong, we reverse the decision promptly.

You can always go to court, or contact a consumer authority or, in the European Union, the Digital Services Coordinator in your country.

12. Third-party services

Wine Brats includes Google Maps features and content. Your use of them is subject to the current Google Maps/Google Earth Additional Terms of Service and the Google Privacy Policy.

Wine-Searcher's own terms apply when you visit wine-searcher.com. Sign in with Apple and Google sign-in are governed by Apple's and Google's terms. We are not responsible for third-party websites or services, their content or their availability.

13. Intellectual property

The app, the website, their design and the Wine Brats name and logo are protected by intellectual-property laws. While you follow these Terms, you may use Wine Brats for personal, non-commercial purposes, or to manage your own restaurant's information if you have a restaurant account. Apart from that, these Terms give you no rights in them. Third-party data, such as Wine-Searcher ratings and prices, may only be viewed in Wine Brats.

14. Apple and the App Store

Your licence to use the iOS app is Apple's Licensed Application End User License Agreement. These Terms add to it and govern the Service; if they conflict about the app licence, Apple's agreement wins.

These Terms are between you and us, not Apple. Apple is not responsible for the app or its content and has no obligation to provide maintenance or support for it. If the app fails to meet a warranty that applies, you may notify Apple, which may refund any price you paid (the app is free); Apple has no other warranty obligation. We, not Apple, handle any claims about the app, including product liability, legal or regulatory compliance, consumer protection, privacy and third-party intellectual-property claims.

You confirm that you are not in a country under a US government embargo or designated as "terrorist-supporting", and that you are not on a US government list of prohibited or restricted parties. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

15. Liability

For everyone. Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, for gross negligence or wilful misconduct, or for anything else that the law, including mandatory consumer protection law, does not allow us to exclude or limit.

Consumers in the European Union, the European Economic Area, the United Kingdom and Switzerland. We are responsible for loss you suffer that is a foreseeable result of our breaking these Terms or failing to use reasonable care and skill. We are not responsible for loss that was not foreseeable, or for business losses. Your statutory rights, including your rights about digital content and services, are not affected.

Everyone else, including business users and, to the extent the law where you live allows, consumers elsewhere: Wine Brats is provided "as is" and "as available", without implied warranties; we are not liable for indirect or consequential loss, lost profits or lost data; and our total liability to you is limited to the greater of US$100 and what you paid us in the 12 months before the claim (Wine Brats is currently free).

If you use Wine Brats for business purposes, for example with a restaurant account, you will compensate us for third-party claims caused by your content or your breach of these Terms.

16. Suspension and ending

You can stop using Wine Brats at any time and delete your account in the app. We may suspend or close your account for a serious or repeated breach of these Terms, where the law requires it, or to prevent harm; section 10 applies. If we close Wine Brats entirely, we will give at least 30 days' notice where we reasonably can. Sections 6 (the licence for wine details), 15, 18 and 19 continue after this contract ends.

17. Changes to these Terms

This version applies to accounts created from 4 October 2026. For accounts created before then, it applies from 3 November 2026; until that date the previous Terms (23 August 2026) still apply to them.

We may change these Terms because of new or changed features, legal or regulatory requirements, security, clarity, or changes to how we run Wine Brats. We will tell you about significant changes in the app or by email at least 30 days before they take effect, unless a change is needed sooner for legal or security reasons, in which case we will tell you as soon as we can.

If you don't agree, you can delete your account before the change takes effect, at no cost. If you keep using Wine Brats after that date, the new Terms apply to you, and for significant changes we may ask you to accept them in the app. Changes don't apply to disputes that started before them. Earlier versions are available on request.

18. Governing law and disputes

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict-of-law rules. If you are a consumer living in the European Union, the European Economic Area, the United Kingdom, Switzerland or another country whose law gives you mandatory protection, you also keep the protection of the mandatory provisions of the law of your country of residence. Nothing in these Terms, including this choice of Delaware law, takes that away.

If you are a consumer, you can bring proceedings in the courts of the country where you live or in Delaware, and if we bring proceedings against you, we will do so only in the courts where you live. Otherwise, the state and federal courts in Delaware have exclusive jurisdiction.

These Terms do not require arbitration, and they do not stop you from taking part in a class or representative action. Before going to court, please contact legal@winebrats.ai so that we can try to solve the problem; this doesn't affect any time limits or your right to ask a court for urgent relief.

19. General

These Terms, together with any additional terms we show you for specific features, are the whole agreement between you and us about the Service. If part of these Terms is invalid, the rest still applies. If we don't enforce a right straight away, we can still enforce it later. We may transfer this contract to a company that takes over Wine Brats, and we will tell you if we do; this won't reduce your rights. You may not transfer your rights under these Terms. Apart from Apple (section 14), no one else has rights under these Terms. These Terms are written in English.
